Syariat Islam, Pengalaman Negara-Negara Islam

Polarisasi berbagai pandangan dari kedua kelompok besar seperti yang telah penulis jelaskan dalam tulisan sebelumnya dapat dijumpai dalam sejumlah referensi. Hartono Mardjono (1997:31) dalam sebuah bukunya menulis bahwa sebenarnya dengan berangkat dari atau melalui ketentuan pasal 29 ayat (2) UUD 1945, seluruh syariat Islam, khususnya yang menyangkut bidang-bidang hukum muamalah, pada dasarnya dapat dijalankan secara sah dan formal oleh kaum muslimin, baik secara langsung atau tidak langsung, dengan jalan diadobsi dalam hukum positif nasional. Pelaksanaan syariat Islam dalam bidang muamalat oleh kaum muslimin, bahkan oleh siapapun juga yang menghendakinya, terbuka lebar melalui azas "kebebasan berkontrak yang dianut pada pasal 1338 Kitab Undang-Undang Hukum Perdata. Dalam kasus ini Hartono mencontohkan bukti keberhasilan lahirnya Undang-Undang Perkawinan, Undang-Undang Peradilan Agama, dan Undang-Undang Perbankan, yang kesemuanya telah berhasil mentransformasikan ajaran-ajaran Islam dalam hukum posisitif nasional. Adalah kenyataan belakangan ini bahwa sebagian ketentuan syariat itu telah diadopsi secara parsial dan diam-diam dalam praktik-praktik ekonomi seperti asuransi dan perbankan. Akan tetapi pengadopsian itu masih sebatas pada tataran hukum perdata (muamalah) saja. Sementara hukum pidana (jinayah) nampaknya hukum syariah belum berjalan. Brangkali inilah yang sedang diperjuangkan oleh sebagian pihak sehingga seluruh aspek hukum itu dapat disyariatkan, atau minimal hukum syariat itu diberi kesempatan untuk mendampingi hukum positif.

Sementara itu, Nurcholish Madjid (2003:6) sebagai salah seorang pelopor intelektualisme Islam liberal di Indonesia mengemukakan bahwa format baru dalam mengartikulasikan Islam di Indonesia adalah menitikberatkan pada substansi, bukan bentuk. Yaitu mengintegrasikan dan mensistensikan secara harmonis antara paham keislaman dan keindonesiaan, mengembangkan basis dan komitmen teologis untuk menyokong demokrasi dan pluralisme agama dan kultural. Oleh karena itu, kalangan intelektual Muslim Indonesia berupaya membangun kesadaran politik umat Islam untuk tidak memaksakan kehendak dan sistem simbol keislaman ke dalam wacana politik bangsa yang sangat plural. Ditambahkan bahwa pengalaman gerakan islamisasi politik di berbagai belahan negara Islam seperti Mesir, Pakistan, Arab Saudi, dan Kuwait telah gagal mengangkat citra Islam yang demokratis dan menghargai HAM. Yang terjadi justru hukum syariat telah sepenuhnya menjadi stagnan di tangan kelompok ulama konservatif dan semangat dinamiknya hilang secara total.

Prinsip gerak dalam struktur syariat sebagaimana dicita-citakan penyair-filosof Pakistan Muhammad Iqbal secara praktis tidak terlihat di negara-negara Islam. Justru yang terjadi sebaliknya; stagnasi dan penolakan perubahan. Setiap legislasi progresif yang memberikan hak-hak Islam kepada kaum perempuan disambut dengan penolakan keras oleh ulama konservatif. Perubahan status qou rezim politik monarkhi di negara Islam tertentu tidak akan terjadi kecuali apabila proses demokratisasi terhadap rezim itu dapat berlangsung. Para penguasa menghalangi setiap upaya ini dan selalu berupaya mencari legitimasi Islam melalui elit ulama. Merekalah yang menolak perubahan apapun dalam hukum syariat. Negara-negara tersebut bertengger pada etos konservatif. Sekularisme dan demokratisasi dianggap sebagai anti-Islam. Hanya dengan demokratisasi masyarakat muslim akan dapat menggapai konsep kewargaan dan penghormatan HAM.

Ditambah lagi, penerapan hukum syariat di negara-negara muslim tersebut tidak ada keseragaman. Terdapat perbedaan yang tajam dalam menginterpretasikan hukum-hukum tersebut. Sebagai contoh, wanita Kuwait hingga belakangan ini tidak diberikan hak memilih, karena bertentangan dengan hukum Islam. Pada sisi lain, di Pakistan, Bangladesh, Turki, dan Indonesia, kaum wanita bukan hanya diberikan hak pilih, tetapi bahkan menjadi pemimpin negara. Di Arab Saudi, kaum wanita tidak boleh mengemudi mobil, sementara di negara lain mereka melakukannya dengan leluasa. Di sebagian negara Islam lainnya, kaum wanita tidak dibolehkan keluar rumah dan pergi ke sekolah, ke pasar atau tempat publik lainnya tanpa ditemani keluarga laki-laki, bahkan dalam keadaan darurat sekalipun. Semua itu dilakukan atas nama Islam.

Syariat Islam di Aceh

Demikian juga di daerah yang telah diujicobakan penerapan syariat Islam seperti halnya di Aceh, masalah lain mengemuka manakala penerapannya belum maksimal. Karena itu banyak pihak malah mengeritik pelaksanaan syariat Islam di wilayah hukum NAD yang masih terkesan sangat parsial dan hanya menyentuh lapisan masyarakat bawah, yang hanya melakukan "dosa-dosa kecil". Sementara para elitnya yang bergelimang dalam berbagai penyimpangan wewenang publik belum tersentuh hukum syariah. Demikian juga pengalaman negara-negara Islam lainnya dalam menerapkan hukum syariat yang belum maksimal dan berbeda pola penerapannya. Sementara di Nanggroe Aceh Darussalam sebagai satu-satunya daerah di Indonesia yang baru saja mencoba memberlakukan syariat Islam, ternyata sampai saat ini telah menuai banyak masalah. Di antara kasus yang menjadi bias dalam penegakan syariat Islam di Aceh yang diangkat oleh sejumlah pengamat adalah masalah pendekatan dalam menyosialisasikan syariat Islam oleh beberapa oknum polisi syariat yang kurang simpatik, kurang mempertimbangkan prosedural dalam bertindak dan mengusut delik perkara pelanggaran syariat Islam, dan tidak jarang menjadi salah kaprah dalam mencapai tujuan. Demikian juga dalam menindak para pelanggar syariat Islam tidak mengindahkan hak pembelaan dan martabat kemanusiaan pelaku yang umumnya kaum perempuan. Sebut saja beberapa pelontaran pandangan dari sejumlah aktivis di Aceh yang intinya merasa belum saatnya syariat Islam itu diformalkan. Di antara mereka adalah saudara Fuad Mardhatillah, Kamaruzzaman Bustamam-Ahmad, Mashudi SR, Cut Husniaty, Juanda, dan beberapa teman lain.

Tetapi walau bagaimana pun, masalah ini cukuplah sebagai bagian problem internal umat Islam. Kita yang akan menyelesaikannya sendiri, baik dalam konteks lokal maupun nasional. Perbedaan pandangan di antara umat Islam dalam menilai jalannya pelaksanaan syariat hendaknya lebih menyempurnakan kekurangan yang selama ini dirasakan. Bukan sebaliknya, justru melemahkan apalagi mengingkari syariat itu sebagai bagian tidak terpisahkan dari tatanan kehidupan umat Islam dalam semua aspeknya. Berbagai hambatan yang masih dialami, sebagaimana diungkapkan Kepala Dinas Syari'at Islam NAD, baik tantangan internal di Aceh maupun tantangan eksternal yang selalu dikaitkan pada isu-isu global seperti perlindungan hak-hak azasi manusia, keseteraan gender, dan demokratisasi diharapkan dapat dijembatani sedemikian rupa sehingga kedua hambatan tersebut melebur dalam satu bangunan kesepahaman bersama yang inheren. Demikian juga dengan hambatan dalam sistem kenegaraan Indonesia dan sumber daya manusia sebagai pemikir dan mufassir yang mampu menyusun langkah dan tahapan kerja pelaksanaan syariat di Aceh.

Berdasarkan catatan di atas, perkembangan pemikiran keislaman terutama dalam konteks Indonesia menarik ditelaah lebih lanjut dalam bingkai kajian akademis seperti halnya masalah respon (menerima dan menolak) terhadap penerapan syariat Islam dengan argumentasi yang dibangun oleh masing-masing pihak. Apalagi kehadiran sejumlah para pembaharu pemikiran Islam di Indonesia dewasa ini telah membawa perubahan baru dalam aspek polarisasi sudut pandang yang lebih luas, terbuka dan toleran dalam melihat dan mengamati pelbagai persoalan keagamaan dalam platform kebangsaan yang begitu plural. Di antara demikian heterogen para pemikir dan tokoh pembaharu itu, maka di antara yang menarik untuk didiskusikan adalah pemikiran para liberalis Islam Indonesia seperti Nurcholish Madjid, Azyumardi Azra, Saiful mujani, Ulil Abshar Abdalla, Masdar F. Mas'udi, Jalaluddin Rahmat, Taufik Adnan Amal, dan sederetan nama lainnya. Mereka telah memberikan konstribusi positif bagi pengembangan pemikiran keagamaan di Indonesia.

Nampaknya, belum banyak diketahui secara mendalam bagaimana dasar pemikiran yang terbangun? Bagaimana pula implikasinya pemikiran tersebut terutama bagi umat Islam Indonesia secara internal? Juga implikasinya bagi syariat Islam itu sendiri dalam tatanan politik di Indonesia. Dengan demikian, kajiian ini menemukan urgensitasnya karena demikian penting masalah yang dicoba angkat untuk diteliti lebih lanjut. Terlebih dalam konteks penerapan syariat Islam di Aceh, dibutuhkan tidak hanya penelitian yang mampu mengungkap segala persoalan yang selama ini mengganjal, tetapi juga dapat menawarkan suatu alternatif baru yang dapat membawa angin segar bagi siapapun.

Opini Pelangi Tipologi Jilbab

Jilbab, secarik kain untuk menutupi kepala dan rambut perempuan, tak lagi menjadi masalah sederhana. Jilbab menyuguhkan kepada kita dua konteks yang berbeda dan saling bertentangan. Suatu waktu, mengenakan jilbab diperlukan usaha keras karena ada yang melarangnya. Namun, di sisi lain, pemakaian jilbab justru dipaksakan. Bila tak mengenakannya akan dijatuhi hukuman: cemeti hingga mati.
Contoh yang pertama, beberapa waktu lalu, beberapa pegawai perempuan di Sogo, Jakarta, mengalami kesulitan dengan pihak manajemen karena mereka memakai jilbab. Demikian juga di beberapa negara di Eropa, khususnya di Prancis, yang saat ini menerapkan pelarangan pemakaian simbol-simbol agama di tempat umum--tak hanya simbol Islam.
Di ranah lain, Menteri Sosial Pakistan Zill-e Huma, 20 Februari lalu, ditembak mati oleh kelompok Islam garis keras di Pakistan gara-gara tak mengenakan jilbab. Demikian juga perempuan-perempuan di Aceh yang tertangkap basah tidak mengenakan jilbab akan dicambuk di muka umum selepas salat Jumat. Di Padang, melalui surat keputusan wali kota, mengenakan jilbab menjadi kewajiban. Beberapa daerah lain di Indonesia juga mempraktekkan hal yang sama: bila ada itikad menerbitkan peraturan tentang moral ataupun syariah, mewajibkan perempuan berjilbab menjadi agenda utama.
Contoh-contoh di atas sengaja saya hadirkan untuk memperlihatkan betapa persoalan jilbab ini sudah dipandang secara hitam-putih. Lebih dari itu, ada semacam ketakutan yang berlebihan dari dua arus tersebut. Apabila hal ini sengaja didiamkan, jilbab akan dimusuhi dan akan terus-menerus dilarang oleh mereka yang membenci. Sebaliknya, mereka yang mendukung jilbab akan terus memperjuangkannya.
Saya kira, di sinilah letak pentingnya mendiskusikan kembali fenomena jilbab. Pihak yang setuju ataupun menolak harus menyadari bahwa jilbab, sebagai fenomena, membawa pesan yang beragam. Menganut satu persepsi saja terhadap fenomena jilbab ini akan menjerumuskan kita pada bentuk penghakiman yang sewenang-wenang. Keputusan apa pun yang diambil, bila berasal dari asumsi yang salah, tak akan pernah bisa menyelesaikan masalah, malah akan menimbulkan masalah yang jauh lebih besar.
Pada hemat saya, paling tidak ada empat tipologi yang bisa dipakai saat melihat fenomena jilbab. Tipologi ini berhubungan dengan motif, bentuk jilbab, dan gaya hidup yang mengenakannya.
Pertama, jilbab atas alasan teologis, yaitu kewajiban agama. Mereka yang mengenakan jilbab ini akan memahaminya sebagai kewajiban yang tidak bisa ditinggalkan. Bentuk jilbab pun sesuai dengan standar-standar syariat, tak hanya menutup rambut dan kepala, tapi juga--menurut sebagian dari mereka--hingga sampai ke dada. Jilbab yang lebar, bila perlu menutupi seluruh tubuh. Perempuan yang mengenakan jilbab seperti ini juga akan berhati-hati bergaul di ruang publik.
Kedua, alasan psikologis. Perempuan yang berjilbab atas motif ini sudah tidak memandang lagi jilbab sebagai kewajiban agama, tapi sebagai budaya dan kebiasaan yang bila ditinggalkan akan membuat suasana hati tidak tenang. Kita bisa menemukan muslimah yang progresif dan liberal masih mengenakan jilbab karena motif kenyamanan psikologis tersebut. Bentuk jilbab yang dikenakan berbeda dengan model pertama, dan disesuaikan dengan konteks dan fungsinya. Demikian juga dengan gaya hidup yang memakainya, jauh lebih terbuka, dan pergaulan mereka sangat luas, berbeda dengan model pertama.
Ketiga, jilbab modis. Jilbab sebagai produk fashion. Saya memandang jilbab model ini sebagai jawaban terhadap tantangan dunia model yang sangat akrab dengan perempuan. Namun, di sisi lain, ada nilai-nilai agama yang berusaha dipertahankan dan sebagai merek dagang. Munculnya outlet-outlet dan acara-acara peragaan busana muslimah mampu menghadirkan model jilbab dan busana muslimah yang telah melampaui persoalan agama.
Dua bulan lalu, di harian Al-Hayat, saya membaca laporan jurnalistik dari Maroko dan Aljazair bahwa para ulama agama di dua negara itu mengecam munculnya jilbab-jilbab modis. Menurut mereka, bentuk-bentuk jilbab tersebut tidak sesuai dengan standar syariat, demikian pula perilaku yang memakainya. Kata seorang ulama di antara mereka, bagaimana mungkin seorang muslimah bisa mengenakan jilbab yang mini dan transparan, kadang rambut dan lehernya terlihat, dan dipadukan dengan kaus yang ketat dan celana jins?
Fenomena ketiga ini sangat menarik saat ini untuk dikaji lebih lanjut. Arus modernisasi dan fashion tak bisa dibendung oleh apa pun. Ia bisa menciptakan fenomena baru. Dan asumsi-asumsi yang dipakai untuk memandangnya pun tak bisa seperti yang ditunjukkan oleh para ulama itu.
Sedangkan di Indonesia, jilbab modis sangat menjamur, sangat digemari kawula muda dan kalangan selebritas. Salah satu simbol yang bisa saya sebutkan adalah Gita KDI, penyanyi dangdut yang fasih bergoyang, yang mengenakan pakaian ketat namun tetap setia berjilbab. Jilbab dan busana Gita tak bisa lagi dilihat melalui model pertama, teologis, karena dalam aturan syariat yang jumud, perempuan jangankan bergoyang, menyanyi saja akan menyulut masalah.
Keempat, jilbab politis. Fenomena ini muncul dari berbagai kelompok Islam yang menggunakan simbol-simbol agama sebagai dagangan politik. Dalam konteks ini, jilbab tidak lagi menjadi persoalan keimanan, kesalehan, dan kesadaran pribadi, namun akan dipaksakan ke ruang publik. Inilah fenomena yang sebenarnya terjadi di Pakistan, di Aceh, dan di beberapa daerah di Indonesia yang berdalih ingin menerapkan syariat Islam.
Saya pribadi bisa menghormati apabila ada muslimah yang ingin mengenakan jilbab sebagai bentuk keyakinan pribadi, tanpa harus memakai standar pribadi tersebut terhadap orang lain. Misalnya pandangan bahwa yang memakai jilbab lebih soleh dan terhormat dari yang tidak memakai. Di sinilah pihak yang selama ini mencurigai jilbab perlu melihatnya secara cermat. Jilbab sebagai keyakinan pribadi tak perlu dimusuhi. Bila hal ini terjadi, akan menjadi senjata bagi varian keempat untuk mempolitisasi peristiwa tersebut.
Bila benar jilbab berhubungan dengan masalah keyakinan dan kesadaran, ia tak perlu peraturan. Di sini, jilbab akan dipakai dan dipahami secara sehat karena merupakan bentuk ekspresi keyakinan dan kebebasan. Jilbab dipakai sebagai model yang bisa memperkaya khazanah busana. Terserah apakah ia dipandang sebagai pakaian agama atau pakaian adat-istiadat.

Namun, yang pasti dan perlu disadari adalah jilbab tetaplah merupakan pakaian individu, yang tidak bisa dijadikan sebagai pakaian publik. Jilbab sebagai produk budaya akan senantiasa berubah. Apabila jilbab dijadikan pakaian publik atas dasar motif agama, namun orang yang tidak meyakini agama itu tetap saja diwajibkan memakai jilbab, sama saja dengan mewajibkan non-muslim untuk salat. Tidak lucu, bukan?

Dalam konteks ini, jilbab tidak lagi menjadi persoalan keimanan, kesalehan, dan kesadaran pribadi, namun akan dipaksakan ke ruang publik. Inilah fenomena yang sebenarnya terjadi di Pakistan, di Aceh, dan di beberapa daerah di Indonesia yang berdalih ingin menerapkan syariat Islam.
Saya pribadi bisa menghormati apabila ada muslimah yang ingin mengenakan jilbab sebagai bentuk keyakinan pribadi, tanpa harus memakai standar pribadi tersebut terhadap orang lain. Misalnya pandangan bahwa yang memakai jilbab lebih soleh dan terhormat dari yang tidak memakai. Di sinilah pihak yang selama ini mencurigai jilbab perlu melihatnya secara cermat. Jilbab sebagai keyakinan pribadi tak perlu dimusuhi. Bila hal ini terjadi, akan menjadi senjata bagi varian keempat untuk mempolitisasi peristiwa tersebut.
Bila benar jilbab berhubungan dengan masalah keyakinan dan kesadaran, ia tak perlu peraturan. Di sini, jilbab akan dipakai dan dipahami secara sehat karena merupakan bentuk ekspresi keyakinan dan kebebasan. Jilbab dipakai sebagai model yang bisa memperkaya khazanah busana. Terserah apakah ia dipandang sebagai pakaian agama atau pakaian adat-istiadat.

Namun, yang pasti dan perlu disadari adalah jilbab tetaplah merupakan pakaian individu, yang tidak bisa dijadikan sebagai pakaian publik. Jilbab sebagai produk budaya akan senantiasa berubah. Apabila jilbab dijadikan pakaian publik atas dasar motif agama, namun orang yang tidak meyakini agama itu tetap saja diwajibkan memakai jilbab, sama saja dengan mewajibkan non-muslim untuk salat. Tidak lucu, bukan?

NO REAL EVIDENCE OF IRAN'S LAUNCH OF NUCLEAR WEAPONS DEVELOPMENT

The editorial in The Jakarta Post on Feb. 28, titled Diplomacy --Muslim or otherwise, on the diplomatic role Indonesia should play in the Muslim world, was interesting and commendable. Regrettably, however, toward the end of the editorial, the Post, in my opinion, misled readers by providing unwarranted recommendations on how Indonesia should position itself on the Iranian nuclear issue. It says, "While we agree that the Iran nuclear issue should be resolved through diplomacy without resorting to violence, we feel that these nations should have taken a stronger position on the suspected nuclear violations Iran is committing." It continues with much stronger wording: "It would be a crime to allow the country the opportunity to develop a nuclear weapons program under the guise of a civilian nuclear energy program just because we are afraid to take a diplomatic stand."
The Post has cast a verdict on Iran and has asked Indonesia to take the same stand as that of Western countries, led by the United States. This stand is that Iran has to be punished based on the suspicion that they are in the midst of developing nuclear weapons through their uranium enrichment activities. Such suspicions have, of course, never been proven and are contradictory to the various statements, analyses and news reports we have seen and heard.
First, the accusation reminds us of the situation just before the American invasion of Iraq in 2003. To date there is no real evidence that Iran is embarking on a program to develop nuclear weapons. Intelligence reports submitted by western and US intelligence agencies to the IAEA were far from accurate, bear no real evidence, and IAEA failed to provide proves and findings of the Iranian suspected nuclear weapons program. Based on his experience in Iraq, former UN chief weapons inspector Hans Blix recently warned Europe, the United States and the UN Security Council that they are ''humiliating' ' Iran by demanding that it suspend uranium enrichment before any negotiations are conducted. "If indeed they produce the highly enriched uranium, I wouldn't say that is prohibited. They are within a legal right to do so as they assert it
is for peaceful purposes." Blix added.
Second, in contrast to Israel and North Korea, which have boasted of their nuclear capability, Iran has continuously denied having a nuclear weapons program. Iran has simply rejected any attempt to deny it the right to possess and develop nuclear technology and knowledge for peaceful purposes, which under the nuclear non-proliferation treaty (NPT) is clearly their right. Iran will most likely not develop a nuclear weapons program, as it is prohibited under a fatwa=
issued by their supreme spiritual leader. The majority of Iranians are Shia, and under the Shia legal hierarchy a fatwa from the supremesp iritual leader is seen as the highest command.
If we look carefully at the Iranian nuclear issue, we will find= inconsistencies and double standards to which the Iranians have been subjected. Different from the way the U.S. has treated the North Korean government, Iran, which has repeatedly declared its willingness to attend open negotiations, has not received a positive response because the U.S. insists Iran must completely halt its uranium enrichment program before negotiations can be held.
The six-party talks on North Korea, which recently produced a breakthrough, did not place a similar precondition on North Korea, which earlier abandoned the NPT and forced International Atomic Energy Agency inspectors to leave the country. Negotiations were continued even after North Korea officially announced its "successful" test of a nuclear weapon test.
We are all aware that the UN Security Council (UNSC) has peformed well below expectations. Among other things, it failed to prevent the U.S. invasion of Iraq. The U.S. uses all kinds of economic and military leverage to pressure UNSC members to follow its course. Failing that, the U.S. never hesitates to veto any resolution which it regards as detrimental to its national interests. Iran, under suspicion of developing nuclear weapons, has become a target of UN
sanctions.
The US even stresses that all options including military are on the table when it comes to Iran. Israel, on the other hand, which recently confessed openly having nuclear capability is free from any UN pressure. The US so far has vetoed nearly all UN resolutions designed to curtail Israeli conducts in the occupied territories and Middle East. Political analysts agree, therefore, that the US foreign policy against Iran in fact has little to do with Iran's presumed nuclear program. The policy is designed to weaken the Iranian government, protect US and Israeli interest, and to check Iranian increasing clout in the region. Iran is considered a stumbling block against the grand design of the Mid East policy of the United States. Under such global realpolitik where should Indonesia stand? As a newly elected non-permanent member of the UNSC representing the Asian region, Indonesia bears a huge responsibility. Its position on various issues and its vote on UNSC resolutions will be transparent and openly judged by the world.
It is true that Indonesia, a developing country still struggling to overcome various economic hurdles and alleviate poverty, remains largely dependent on the "kindness" of stronger economic powers such as the U.S. and Japan. From this point of view, Indonesian foreign policy should be directed more toward safeguarding its national interests with the main focus on its economy. On the other hand, our Constitution clearly mandates the government to participate actively in global diplomacy and take a resolute position toward achieving just and lasting peace in the world.
In the case of the Iranian nuclear issue, the United Nations' position, which is largely controlled by the U.S., is clearly disproportionate. This will merely endanger world peace further, as Iran is determined not to bow to the external pressure to which it feels it is being unjustly subjected.
It is a crime, to borrow the Post's terminology, to punish a country based on unproved suspicions. As a member of the UNSC, Indonesia should neither follow the position of those countries that feel "threatened" by Iran, nor should we take a confrontational stance against the super-power.
However, this does not mean we should simply remain neutral and abstain on this issue. Indonesia should instead be more creative and offer an alternative approach in the form of a more workable and just resolution that will bring the parties together at the negotiating table.
Talks similar to the ones on North Korea would be advisable. Only this time the participating countries should be widened to include major players in the Middle East.
The recent development where the U.S. is now willing to sit at the same table with Iran and Syria to find a solution to the Iraqi debacle is encouraging. This initiative should not be wasted by limiting the scope of the dialog only to Iraq. Wider and more urgent problems such as Palestine and the Iranian nuclear issue should also be on the agenda, once progress on Iraq is achieved. Indonesia needs to maintain a strong and unwavering position consistent with its long-term national interests and world peace. Only by doing so will Indonesia be reckoned with in the global political arena.

Injil Minggu Prapaskah III/C

Luk 13:1-9

MENGARAHKAN DIRI KE SANA, KE KEHIDUPAN!!

Luk 13:1-9 yang dibacakan pada hari Injil Minggu Prapaskah III/C ini memuat dua bagian. Yang pertama mengisahkan dua kejadian yang dapat menjadi bahan pelajaran untuk "bertobat" (ayat 1-3 dan 4-5) sedangkan bagian kedua (ayat 6-9) berbentuk perumpamaan yang melengkapi ajakan tadi.

Dalam kehidupan rohani bertobat berarti semakin mengalihkan kehidupan dan perhatian kepada Tuhan sambil dengan menyadari pelbagai kekeliruan yang telah terjadi. Orang yang merasa terhukum bisa diajak agar tidak lagi memandang diri selalu ada dalam keadaan itu. Orang yang merasa hidup beres di hadapan Tuhan masih perlu belajar agar tidak dibuai keyakinan semuanya sungguh begitu. Orang yang menjalankan agama dengan baik juga diajak agar berhati-hati agar tidak memperalat agama demi gengsi dan kepentingan sendiri.

TAFSIRAN POLITIK ATAU PENJELASAN AGAMA?

Kejadian macam apa dilaporkan kepada Yesus dalam ayat 1-3? Tak ada berita lain kecuali yang terdapat di sini. Dapat diperkirakan, orang-orang Galilea itu tersangkut dalam gerakan untuk melepaskan diri dari kekuasaan Roma. Mereka ditangkap Pilatus ketika berziarah ke Yerusalem. Orang-orang itu dibunuh seperti korban sembelihan yang mau mereka bawa ke Bait Allah. Gubernur Romawi itu memang terkenal kejam menumpas beberapa upaya pemberontakan.

Mengapa perkara itu diceritakan kepada Yesus? Ada yang menjelaskan, orang hendak mengetahui sikap politik guru tersohor ini. Maklum Yesus sendiri berasal Galilea. Bila mengecam pembunuhan para peziarah itu, Yesus akan berhadapan dengan kekuasaan Romawi. Tetapi bila membenarkan, ia akan dianggap bersikap kurang nasionalis dan dicap tidak membela bangsa sendiri. Jadi agak sama dengan pertanyaan apa orang Yahudi boleh membayar pajak kepada Kaisar. Memang reaksi Yesus tidak pro atau kontra peristiwa penangkapan dan pembunuhan orang-orang Galilea itu. Tetapi penjelasan ini kurang dapat menerangkan mengapa Yesus juga membicarakan nasib delapan belas orang Yerusalem yang mati tertimpa menara di Siloam yang diutarakan dalam ayat 4. Jelas orang-orang naas ini tidak beragenda politik.

Karena penjelasan di atas tidak memuaskan, beberapa ahli tafsir lebih memusatkan perhatian pada reaksi Yesus. Mereka menjelaskan bahwa Yesus bermaksud menolak gagasan bahwa pengalaman buruk, malapetaka, atau kematian yang tak wajar adalah hukuman akibat dosa atau kesalahan. Ia menandaskan, baik orang-orang Galilea maupun orang-orang Yerusalem yang tertimpa menara itu tidak lebih berdosa dari orang-orang lain. Dengan perkataan lain, Yesus menyarankan agar orang mulai memperbaiki diri sendiri dahulu dan bertobat. Penjelasan ini menarik, dan tentu semua orang setuju betapa perlunya orang bertobat. Namun kita bukan hanya berminat pada seruan bertobat, kita mau tahu Injil hari mengajarkan bertobat dari apa dan untuk apa. Untuk itu marilah kita mencoba memahami dengan kunci yang diberikan Lukas sendiri.

ORANG GALILEA DAN ORANG YERUSALEM

Petikan hari ini menampilkan dua nama tempat, yang pertama Galilea, yakni daerah di utara, dan yang kedua kota Yerusalem. Di Israel ada tiga wilayah: paling utara disebut Galilea, paling selatan dikenal dengan nama Yudea (di wilayah ini terletak Yerusalem), antara kedua wilayah tadi terdapat Samaria. Orang Yudea, terutama yang dari Yerusalem, tidak begitu menyukai orang Samaria maupun orang Galilea. Lukas memakai nama-nama geografis ini untuk menenun Injilnya. Lihat perumpamaan orang Samaria yang baik hati terhadap orang Yerusalem yang naas dalam Luk 10:25-37. Bagaimana sikap orang Galilea terhadap orang Yerusalem? Lihat saja apa yang dikerjakan Yesus di Yerusalem - ia orang Galilea!

Memang ada persaingan bebuyutan antara orang Galilea dengan orang dari Yerusalem dan sekitarnya. Dapat dikatakan daerah utara umumnya lebih makmur karena lahan pertanian di sana subur dan penduduknya menikmati perekonomian yang lebih maju. Di sana juga beberapa waktu sebelum zaman Yesus mulai berkembang pesat bisnis perikanan danau. (Karena itu Yesus memilih nelayan sebagai murid-muridnya, mereka itu CEO dalam bisnis perikanan zaman itu, kayak lulusan ATMI yang tentunya bukan sekadar tukang las.) Secara politik, Galilea juga lebih sering bergolak daripada Yerusalem. Mereka lebih berani menghadapi kekuasaan asing, baik itu Yunani maupun Romawi. Tetapi masalah utama di Galilea sendiri ialah adanya ketimpangan sosial kendati secara umum wilayah itu cukup berkembang. Orang yang memiliki kemungkinan untuk maju sering kurang peduli terhadap kaum yang berkekurangan. Sebetulnya perkara ini bukan barang baru. Nabi Amos dan Hosea yang mengamati perilaku orang utara sering menelanjangi ketimpangan sosial di sana. Maka seruan agar menarik pelajaran dari kejadian orang Galilea itu juga seruan agar orang menumbuhkan kepedulian terhadap orang-orang miskin.

Orang Yerusalem merasa lebih memiliki prestise religius. Maklum pusat ibadat berada di kota itu. Para pemimpin agama juga tinggal di sana. Oleh karena itu orang Yerusalem acapkali agak memandang rendah orang Galilea. Gema sikap ini terdengar dalam Yoh 1:46. Di situ Natanael berkomentar mengenai Yesus, yang orang Galilea itu, dengan mengatakan, "Mungkinkah sesuatu yang baik datang dari Nazaret". Juga dalam Yoh 7:52 Nikodemus yang membela Yesus di hadapan kaum Farisi di Yerusalem malah ikut didamprat "Apakah engkau juga orang Galilea? Selidikilah Kitab Suci dan engkau akan tahu bahwa tak ada nabi yang datang dari Galilea!"

Dalam Luk 13:4 ada sindiran bahwa orang Yerusalem bukan pula orang suci. Menarik diperhatikan, dalam ayat itu nama kota itu ditulis sebagai "Ierousaleem" . Dalam ulasan Injil Minggu Adven I disinggung bahwa bentuk ini dipakai Lukas guna menyebut kota Yerusalem sejauh dihuni orang-orang yang menolak kehadiran Yesus. Tapi bila ditampilkan dalam perspektif mereka yang menerima kedatangannya, maka nama kota itu ditulis sebagai "Hierosolyma" . (Untuk memudahkan, "Ierousaleem" diplesetkan saja sebagai "Yeru-zalim" - kota kezaliman, sedangkan "Hierosolyma" lebih dekat dengan "Yeru-syaloom" - kota kedamaian.) Dalam Injil hari ini Yerusalem memang ditampilkan sebagai kota yang tak bersih dari kesalahan, maka perlu bertobat. Tentunya, bertobat bukan dalam arti menyesali kesalahan ini atau itu tok, melainkan berusaha menjadi orang-orang yang menerima Yesus, dari "Ierousaleem" bertobat menjadi "Hierosolyma" .

Ringkasnya, masalah di Galilea ialah perbedaan antara orang kaya dan orang miskin, adanya ketakadilan sosial yang makin memojokkan orang miskin. Masalah orang Yerusalem ialah sikap saleh tapi sombong, merasa aman, "self-righteous" , mau mengatur Tuhan. Nah, dengan ini dapat disimak kembali seruan Yesus untuk bertobat yang ditujukan baik bagi orang yang memikirkan keadaan orang Galilea (ayat 3) maupun bagi yang berpikir mengenai kejadian di Yerusalem yang kota zalim itu (ayat 5). Dua wilayah itu melambangkan dua tipe kedosaan yang perlu dijauhi: kelekatan pada kekayaan sehingga melupakan sesama ("dosa orang Galilea"), dan sikap merasa diri sudah jadi orang lurus sehingga berlaku munafik dan bahkan memusuhi Yesus orang suruhan Tuhan sendiri ("dosa orang Yerusalem").

Perhatian kepada dua macam kedosaan itu digarisbawahi dalam Injil Lukas. Ingat perumpamaan orang kaya yang bodoh yang hanya memikirkan diri sendiri Luk 12:13-21 (tipe "keberdosaan Galilea") dan perumpamaan orang Farisi yang merasa diri lebih baik daripada pemungut cukai dan kaum pendosa lain Luk 18:9-14 ("tipe keberdosaan Yerusalem").

KEMURAHAN TUHAN DAN PERHATIAN PENGURUS KEBUN

Memang tobat lebih gampang digambarkan dengan menampilkan hal-hal yang mengerikan yang bakal terjadi bila orang tidak melakukannya. Namun pembicaraan seperti itu tidak banyak berarti bila tidak disertai kepercayaan akan kemurahan Tuhan serta usaha untuk membuat orang sungguh merasakan kemurahanNya. Tak mengherankan, Injil Lukas hari ini menyatukan seruan bertobat yang nadanya keras itu dengan perumpamaan yang menjelaskan bagaimana kerahiman Tuhan itu bisa menjadi kenyataan. Pohon ara yang tidak berbuah selama tiga tahun itu masih mendapat kesempatan setahun lagi..., boleh jadi tahun depan akan berbuah dan menjadi pohon yang baik! Perumpamaan itu juga memperlihatkan betapa besarnya peran pengurus kebun. Ia memintakan kelonggaran. Bukan itu saja. Ia bersedia mengusahakan agar pohon ara mandul itu bisa menjadi baik, ia menggemburkan tanah sekeliling, ia memberi rabuk. Hati sang empunya kebun melunak melihat kecintaan pemelihara kebun terhadap pohon yang naas itu. Pengurus kebun itu bukan administrator yang bekerja atas dasar kalkulasi untung rugi melulu, yang lega bila neraca klop angka-angkanya. ..yang tersenyum bangga bila bangku gereja penuh. Pengurus kebun itu orang yang mencari mereka-mereka yang sulit, yang sudah tanpa harapan lagi. Pengurus kebun ialah orang masih berani mendekati mereka-mereka yang menjengkelkan Tuhan sendiri. Tak meleset bila dikatakan, kita para pelayan umat diminta agar tidak membiarkan Tuhan putus asa. Lebih dari itu, dengan berani perumpamaan itu mengajarkan kita hendaknya jangan ikut-ikutan pergi sekalipun Tuhan sendiri sudah mau meninggalkan orang-orang itu! Kita masih tinggal di sana, kita bukan pemilik, kita ini pemelihara dan masih bisa berusaha agar mereka tidak ditebang.

God our Father,
we give you thanks
for the talents you have given to mankind,

Lord, it’s good

about the abuses of human rights

Konferensi PAPERNAS Jatim

diserang sisa-sisa Orba

Walaupun Suharto sudah turun dari « tahta » sejak 1998 tetapi kita semua menyaksikan bahwa sisa-sisa kekuatan politik rejim militer Orde Baru dewasa ini masih bercokol di berbagai bidang eksekutif, legislatif, judikatif dan juga di bidang kebudayaan (termasuk bidang agama).
Salah satu di antara banyak buktinya yang terakhir adalah apa yang terjadi di Batu (Jawa Timur), dengan adanya serangan brutal dari satu golongan yang menamakan Front Anti Komunis Indonesia terhadap Konferensi Daerah PAPERNAS (Partai Persatuan Pembebasan Nasional) tanggal 4 Maret 2007.

Mengingat sangat seriusnya peristiwa di Batu ini bagi kehidupan demokratis di Indonesia, berikut di bawah ini disajikan pernyataan pers (press release) DPP PAPERNAS yang ditandatangani Dominggus Oktavianus, Ketua Bidang Politik dan Demokratisasi, disertai dengan komentar berikutnya.

Press release DPP PAPERNAS tersebut berbunyi sebagai berikut :

« Sekitar pukul 15.00 WIB hari ini (4/3 07) massa yang menamakan diri Front Anti Komunis Indonesia (FAKI) melakukan penyerangan terhadap Konferensi Daerah I PAPERNAS Jawa Timur (KONFERDA I PAPERNAS JATIM) di Batu, Jawa Timur.

Konferda I Jatim diikuti oleh 200 peserta dari 24 kabupaten/kota se-Jatim dan dihadiri oleh Ketua Umum DPP PAPERNAS, Sdr. Agus Prioyono. Tindakan tidak beradab, anti demokrasi, beserta fitnah tidak berdasar yang dilakukan FAKI tersebut adalah yang kedua kalinya, setelah penyerangan atas Kongres Pendirian Partai di Kaliurang, Yogyakarta bulan Januari lalu.

Seluruh prosedur hukum telah dilalui oleh panitia untuk menyelenggarakan Konferensi ini, sehingga seharusnya mendapatkan perlindungan dari aparat penegak hukum. Namun yang terjadi di lapangan, aparat kepolisian membiarkan aksi teror dan perusakan dilakukan oleh massa FAKI.

Kejadian memalukan yang terus berulang ini mengindikasikan bahwa cara-cara Orde Baru masih digunakan oleh sebagian faksi sisa Orba di dalam institusi Tentara Nasional Indonesia (TNI). Modus yang sama terjadi saat Kongres pembentukan PAPERNAS Yogyakarta, yaitu pihak Komando Resort Militer 072 Pamungkas Yogyakarta melakukan tekanan terhadap Kepolisian DIY untuk menghambat terselenggaranya Kongres.

Dengan demikian, telah terjadi pelanggaran serius terhadap fundamen demokrasi yaitu kebebasan berserikat, berkumpul, dan mengeluarkan pendapat. Fundamen demokrasi ini kami pandang sangat krusial, karena dengan kebebasan tersebut maka Bangsa ini akan mendapatkan kesempatan untuk bangkit dari keterpurukan, melalui pembangunan kekuatan rakyat yang sadar akan hak-hak ekonomi, politik, dan sosial budaya.

Oleh karena itu DPP PAPERNAS menyatakan sikap:

1. Menuntut kepada pemerintahan SBY-JK untuk menjamin hak-hak mendasar tersebut dijalankan oleh seluruh rakyat Indonesia, dengan menindak tegas pihak-pihak yang anti-demokrasi, anti kemajuan, dan ingin mempertahankan atau meningkatkan kekuasaannya dengan cara-cara yang fasistik dan tidak beradab.

2. Menuntut kepada institusi TNI dan POLRI untuk membersihkan institusinya dari faksi-faksi Orde Baru yang anti demokrasi, anti kedaulatan Bangsa, dan anti rakyat.

3. Mendesak Kapolri Jend.Pol. Sutanto untuk mencopot Kapolresta Batu, AKBP. Bambang Priyo Handoko dari jabatannya karena tidak melakukan perlindungan dan pengamanan terhadap acara yang sah menurut hukum, yang berarti Kapolresta telah melanggar UU No. 2 Tahun 2002 Tentang Kepolisian Negara Republik Indonesia.

Kami menyerukan kepada seluruh kader dan anggota PAPERNAS di tingkat Nasional maupun di basis-basis rakyat untuk tidak menjadi mundur, namun sebaliknya semakin semangat melanjutkan kerja-kerja politik bersama rakyat.
Situasi ini membuktikan bahwa pilihan politik yang kita ambil menghasilkan reaksi dari pihak-pihak yang tidak menginginkan cita-cita kedaulatan rakyat dan Bangsa Indonesia diwujudkan.

Sekaligus kami menyampaikan permohonan solidaritas dari saudara-saudara sebangsa dan setanah air pembela demokrasi dan yang sama cita-citanya, untuk menyampaikan protes terhadap kejadian ini kepada pemerintah cq. Kepolisian Negara Republik Indonesia. » (kutipan press release PAPERNAS selesai).

Perlu pernyataan solidaritas dari mana-mana

Kejadian penyerangan FAKI terhadap konferensi daerah PAPERNAS di Batu ini perlu menjadi perhatian dari seluruh gerakan demokratis di Indonesia, yang terdiri dari berbagai parpol, LSM atau Ornop, atau bermacam-macam gerakan dan perkumpulan. Karena, aksi penyerangan FAKI (sudah kedua kalinya) terhadap PAPERNAS ini merupakan bukti bahwa praktek-praktek terror yang dilakukan selama 32 tahun Orde Baru masih terus bisa digunakan - dewasa ini -- oleh unsur-unsur atau pendukung Orde Baru.

Aksi-aksi terror, intimidasi, fitnah, atau penyebaran « momok komunis » akhir-akhir ini sering digunakan sisa-sisa rejim militer Orde Baru, untuk mencoba mendiskreditkan berbagai perlawanan rakyat yang beraneka-ragam dan makin meluas untuk menuntut perbaikan hidup, melawan pengangguran dan kemiskinan, melawan korupsi dan penyalahgunaan kekuasaan, serta menentang neo-liberalisme. Kalau aksi-aksi terror, intimidasi dan fitnah semacam itu tidak dilawan bersama oleh berbagai gerakan atau kekuatan anti-Orde Baru, maka negara kita Indonesia akan kembali ke zaman gelap Suharto dkk.

Oleh karena itu, sudah sepatutnyalah kiranya kalau berbagai kekuatan demokratis dan anti-Orde Baru segera berramai-ramai mengeluarkan pernyataan solidaritas kepada PAPERNAS dan menuntut kepada pemerintahan SBY-JK untuk menjamin hak-hak mendasar seluruh warganegara Indonesia, dengan menindak tegas segala tindakan anti-demokrasi. Pernyataan solidaritas dari berbagai kalangan di Indonesia dan juga di luarnegeri terhadap PAPERNAS akan menunjukkan bahwa aksi-aksi golongan yang masih bisa ditunggangi oleh sisa-sisa Orde Baru (yang sebagian bersembunyi di kalangan aparat-aparat negara) untuk mengadakan terror, intimidasi, dan tindakan-tindakan anti-demokratis lainnya, tidak bisa dibiarkan terus begitu saja tanpa mendapat perlawanan yang selayaknya..

Siapa yang berdiri di belakangnya?

Serangan golongan yang menamakan diri Front Anti Komunis Indonesia terhadap konferensi daerah PAPERNAS di Batu ini patut kiranya ditelaah dari berbagai segi. Siapa atau fihak mana yang sebenarnya berdiri di belakangnya atau menjadi “dalangnya”? Apakah golongan ini tidak senafas atau sejiwa dengan aksi-aksi atau gerakan anti-komunis di zaman Orde Baru? Kita sudah tahu bahwa di masa yang lalu rejim militer Orde Baru berhasil “merangkul” (denganbeaya yang mahal sekali !) sebagian golongan Islam, untuk melancarkan secara besar-besaran kampanye anti-Sukarno dan anti-komunis, yang sejalan dengan politik nekolim AS dan sekutu-sekutunya.

Dalam jangka yang lama sekali, rejim militer Suharto, yang dengan jelas dan terang-terangan melakukan kolaborasi erat sekali dengan imperialisme AS, telah membuka lebar-lebar pintu Indonesia untuk penanaman modal asing yang menguras kekayaan bumi Indonesia. Imperialisme AS ini jugalah yang sejak bertahun-tahun mengaduk-aduk Irak, dan berusaha mengadu-domba berbagai bangsa Arab dan negara Islam dan Israel di Timur Tengah demi kepentingan AS sendiri. Jelaslah kiranya bagi banyak orang bahwa masa kolaborasi antara rejim militer Orde Barunya Suharto dengan imperialisme AS adalah salah satu halaman hitam, yang penuh dengan darah dan jiwa, dalam sejarah bangsa Indonesia.

Perjuangan nasional melawan imperialisme AS.

Dilihat dari segi perjuangan menentang imperialisme AS (dengan Bank Dunia-nya, IMF-nya, WTO-nya, singkatnya neo-liberalisme- nya atau neo-kapitalisme- nya) maka serangan Front Anti Komunis Indonesia (FAKI) terhadap konferensi daerah PAPERNAS di Batu - dan Kaliurang - merupakan suatu pengkhianatan terhadap kepentingan nasional rakyat Indonesia. Sebab, program perjuangan PAPERNAS adalah mengajak seluruh bangsa Indonesia untuk membebaskan negara dan rakyat dari cengkeraman kepentingan- kepentingan modal monopoli asing.

Patut diketahui bahwa konferensi daerah PAPERNAS di Batu dihadiri oleh 200 peserta dari 24 kabupaten/kota se-Jawa Timur. Jadi, merupakan konferensi jang cukup besar. Konferensi ini adalah langkah untuk menindaklanjuti hasil-hasil kongres pembentukan PAPERNAS di Kaliurang tanggal 18-20 Januari 2007.Kongres pembentukan/ pendirian partai di Kaliurang ini diikuti oleh 370 perwakilan dari 21 provinsi dan 120 kota/kabupaten, dan 20 peserta peninjau dari kalangan intelektual (seperti Dr. Dede Oetomo dan Dr. George Junus Aditjondro), serta dari utusan organisasi-organisa si lain yang diundang.

Namun, kongres di Kaliurang itu telah berlangsung di bawah tekanan fisik, psikologis, dan politis, antara lain oleh karena adanya aksi-aksi terror Front Anti Komunis Indonesia dan pembatasan-pembatas an yang berusaha dilakukan oleh aparat-aparat negara. Dalam menghadapi situasi yang demikian itu, kongres terpaksa dipercepat, tetapi berhasil mengambil
keputusan-keputusan penting yang bisa ditindaklanjuti di kemudian hari.

PAPERNAS adalah partai front yang luas dan supel

Lahirnya PAPERNAS di bulan Januari 2007 merupakan sumbangan penting dalam perjuangan rakyat Indonesia untuk melawan imperialisme, dan untuk mewujudkan tatanan masyarakat Indonesia Baru yang mandiri, demokratik dan sejahtera.

Program mendesak PAPERNAS adalah : menyelesaikan krisis dengan penghapusan hutang luar negeri, nasionalisasi industri pertambangan, dan membangun industrialisasi nasional, yang disebut dengan Tri Panji Pembebasan Nasional.

Dalam bidang strategi dan taktik telah digariskan oleh PAPERNAS bahwa pemilu 2009 dijadikan sebagai momentum dalam program perjuangan rakyat Indonesia melawan imperialisme dengan Tri Panji Persatuan Nasional sebagai program mendesak dan Front Persatuan sebagai alatnya. Jadi, PAPERNAS adalah suatu partai front, yang berusaha mempersatukan sebanyak-banyaknya dan sebesar-besarnya berbagai kekuatan dalam masyarakat Indonesia.

Oleh karena itu, isi semboyan yang dipakai PAPERNAS untuk berbagai keperluan dan kesempatan cukup mencakup kepentingan nasional yang luas dan patriotik, yaitu « Cukup sudah jadi bangsa kuli, bangkit jadi bangsa mandiri ! ». Semboyan lainnya, yang juga mengandung pesan yang menjangkau jauh adalah :

“Hapus Utang Luar Negeri!

Nasionalisasi Industri Pertambangan!

Bangun Industri Nasional untuk Kesejahteraan Rakyat!”
